Subject: Re: [SEL] [AT] Discharge Chains
Several months ago I let you folks know about a lawsuit some neighbors had
filed against our farm. I wanted to let everyone know that the day before
the final court date ( after several delays and other motions), they did
drop the lawsuit. It was full of drama.
I'll spare you the details, but the short story is their lawyer actually
quit on them in court, on the first day. The judge was not amused and gave
them 2 days to find new counsel. They found another lawyer who apparently
talked some sense into them and convinced them to drop the case.
Unfortunately this left us with the decision to pursue the motion to
sanction or drop it and allow them to drop the case. If they lost that they
would have had to pay my lawyers fees. But my lawyer counseled me to drop
the sanction and allow them to drop their suit. He said there's just no way
to know what the judge might be thinking. He did force them to sign a
Consent Decree. This gives us a fast track towards a frivolous lawsuit if
they try anything again.
I appreciate all the support and words of encouragement!
